TitleInternational Development Law Organization (IDLO) is an intergovernmental organization with twenty-five years of experience in promoting the rule of law and good governance. IDLO is working in developing countries, countries in economic transition and countries emerging from armed conflicts. To date, the States - IDLO members are: Australia, Austria, Bulgaria, Burkina Faso, Egypt, Italy, China, Colombia, Netherlands, Norway, Romania, Senegal, Sudan, USA, Tunisia, France, Ecuador. Currently in various stages of the accession process to the Constituent Agreement are also some other countries. In 2001 the UN General Assembly has appropriated IDLO an official status of observer, authorizing the opening of the consolidated IDLO Mission to the UN in New York. The IDLO task is upholding the rule of law and promoting the use of legal resources in the process of developing countries and countries with economies in transition. Organization authorized to conduct training, provide technical assistance, engage in research work and scientific publications. To date, IDLO has worked in 176 countries, 17.000 lawyers covering its activities. Today there are 42 legally registered Association Trainees IDLO in 42 countries. These associations are working at the national and regional level to advance the mission of IDLO. The organization is supported solely by voluntary donations from governments, multi-disciplinary organizations, foundations and private firms. IDLO provides developing countries with resources, mechanisms, and professional skills and experience to create or consolidate the rule of law and good governance. We are working with judges and lawyers, legal and political institutions, as well as governmental and nongovernmental organizations to achieve the 6 key strategic objectives that directly contribute to the development of: - Economic Development and Trade; - Assistance in promoting peace; - Development of institutional capacity; - Improved well-being and helping people in poverty; - Research and strategic planning. IDLO uses a variety of different programs to achieve the set goals. These programmes are fully consistent with the rate of development desired results of the High Level United Nations World Summit of 2005, and the Paris Declaration. Both these policy documents reinforce the concept of aid to developing countries, at which the recipients can decide the strategy themselves. IDLO programmes include: - Dialogue on development strategies and policies; - Technical assistance; - Education; - World Health Organization, interns, graduates and partners of IDLO; - Research; - Publications. Information on the progress of work under the Memorandum of Understanding signed between the Supreme Court of the Kyrgyz Republic and the International Development Law Organization. In December 2006, the Memorandum of Understanding between the Supreme Court of the Kyrgyz Republic and the International Development Law Organization (IDLO) was signed within the project of EBRD and DENR on strengthening the capacity of the judiciary in commercial law in the Kyrgyz Republic (hereinafter - the Project). To achieve the points of the Memorandum of Understanding the following activities were executed and carried out: 1. Training for judges of the Kyrgyz Republic, working in the field of commercial and civil law. Judges working in the field of commercial law and civil law in amount of about 270 judges, as well as employees of local courts in the amount of 20-30 people have been trained under the Project. The training used a specially designed training programmes, handbooks, including specific examples and comparative legal analysis. In this case, the teaching staff consisted of a well-known practitioners of judges and legal professionals are also invited foreign experts. The teaching staff has been pre-trained to new methods of conducting seminars, including the introduction of interactive teaching methods (e.g. role-playing games) and subsidiary forms of teaching such as the use of slides, presentations, mini-lectures, etc. The trainings of judges and local courts have passed on the following topics: • land law and real estate; • contracts for the sale of goods; • accounting; • the documentation of the transaction; • taxation; • arbitration; • competition law; • legislation on securities market; • organizational forms of business; • improving the skills of judicial decisions preparation (civil procedure), and courses on computer literacy; • the administrative process. 2. The internship program in the courts of the Russian Federation and the Republic of Kazakhstan for the local courts of the Kyrgyz Republic. From February to March 2007, 12 local judges have been trained in the courts of the Republic of Kazakhstan, where they received valuable knowledge and experience of our friendly colleagues from the Republic of Kazakhstan. From January to February 2008, 12 local judges for training in arbitration were sent to the courts of the Russian Federation. In this case, the number of selected judges included young judges, judges with leadership qualities who actively participate in seminars. Judges who participated in the internship, are actively involved in conducting follow-up training workshops to disseminate experience and knowledge to other local courts. Host Party (Kazakhstan, Russia) have developed specifications for the judges involved in internships. These characteristics included in the personal affairs of our judges. 3. Establishment and equipping libraries of commercial law at the Supreme Court of the Kyrgyz Republic. To achieve this paragraph the following activities have been planned and carried out: • more than 200 books and publications in the field of commercial law were purchased, mainly from Russia, later it is planned to increase the number of books and publications, the difficulty is to find a Russian-language books in the field of commercial law; • established a specialized programme for working with "Irbis" electronic catalogue, to be tested for its work; • a separate room is equipped in the building of the Supreme Court of the Kyrgyz Republic; • computer equipment which is connected to the Internet was purchased, it is also planned to purchase an additional copying and scanning equipment; • Negotiations on opening access to electronic libraries of foreign countries via the Internet are conducted; • Librarian of the Supreme Court of the Kyrgyz Republic passed an internship in the library of the Academy of Justice of the Russian Federation; • Specialist of International Department of the Supreme Court of the Kyrgyz Republic held a collection of information on library activities of the neighbouring Republic of Kazakhstan (Astana). It should also be noted, that after the decision on the building of the Training Centre for Judges of the Supreme Court of the Kyrgyz Republic, this library will be moved into the new building of the Judicial Training Centre so that trainees, judges and candidates for judges would have permanent access to scientific literature. 4. Preparation and distribution of manual for judges on the basic issues of commercial law. This manual is currently being technically edited and will be distributed in the future among the judges of the Kyrgyz Republic. All topics on which there have been conducted seminars for judges, will be included in the content of the manual. www.benchbook.el.kg More This project has also paid for and installed the "Adviser" information and legal system as well as the upgrade of the system within one year to the computers of local courts, in an amount of 426 computers. From February to March 2009, independent evaluators conducted the monitoring and evaluation of the Project EBRD and IDLO. On March 16, 2009 Phase № 4 on the preparation of candidates for judges and further training of judges in civil and commercial law of the EBRD and IDLO Project has started. |
